I understand that the Consultant/trainer will work directly with me and my dog to impart contemporary animal behavior knowledge that best fits our needs, and that successful companion dog programs depend on a combination of learned skills on the part of the dog and owner. Behavior is not static; an animal will not continue to perform even trained behaviors without ongoing practice. Especially in cases involving any type of aggression, although behavior may be modified, the dog is never considered "cured". A dog's behavior is ultimately the owner's responsibility. The consultant will make every reasonable effort to help us attain goals but makes no guarantees of performance on the part of the Client or dog as a result of providing professional animal Behaviour consultations or training.

The client acknowledges that obedience training/behavior modification may be an activity in which damage or injury to dog(s) and/or persons may occur. The client will assume full financial/moral responsibility for the actions of their dog(s). Client further acknowledges that dog(s) may be exposed to a variety of environmental conditions which include, but are not limited to, vehicular travel, interaction with people and other animals, exposure to adverse weather, and exposure to areas with crowds and all types of traffic.

I/We the Client agree that by hiring Black Dawg Bark I, my/our heirs, assignees, and legal representatives will not make a claim against, sue, or attach the property of the Consultant, his/her family, acquaintances, or any other person acting on his/her behalf (herein referred to as "Agents"), for injury or damage to or by a dog(s) resulting from action or negligence, however, caused, by Consultant or Agents. I/We Client forever release Consultant and/or Agents from any and all liability and demands which I/We Client, and my/our heirs, assignees, and legal representatives may have or may hereafter have for injury or damage to or by dog(s) and assume all risks thereof.

Client and Consultant hereby agree to mediate and/or arbitrate any misunderstandings that may arise under the terms contained herein. In any action or proceeding arising out of this agreement, the prevailing party shall be entitled to reimbursement of costs and legal fees.

This Contract for Training Services supersedes all other agreements, written or oral, previously made between Client and Training Consultant. I also agree to allow Black Dawg Bark to video me, my dog(s), and my property. I authorize Black Dawg Bark LLC to copyright, use, or publish these videos for educational purposes.

I agree to allow Black Dawg Bark to contact my dog's veterinarian to discuss behavior and medical history.

THIS CONTRACT LIMITS OUR LIABILITY—PLEASE READ IT

INDEMNITY AGREEMENT AND RELEASE OF ALL LIABILITY

FOR USE OF Black Dawg Bark TRAINING/BOARDING/DAYCARE SERVICES

BY ENROLLING YOUR DOG(S) IN OUR SERVICES,

YOU HAVE READ, UNDERSTAND AND ACKNOWLEDGE THIS SERVICE CONTRACT.

As the owner or legal caretaker (“Dog Owner) of the below-referenced dog (“Owner’s Dog” or “my dog”), I have read, understand, and agree to the following:

Terms and Conditions

Black Dawg Bark and its employees, directors, partners, affiliates, and assigns will exercise the utmost due care to protect the health and safety of my dog(s) while using the services associated with Black Dawg Bark (“Services”). In consideration of the Services and as an express condition thereof, I hereby waive and release, on behalf of myself, and my heirs, personal representatives and assigns, to the fullest extent permitted by law, any and all claims, including those relating to damage, illness, injury, death and/or escape, against Happy-dog Training Hub and their employees, directors, partners, affiliates and assigns (collectively, the “Released Parties”) arising out of my dog(s)’s use of the Services. I further agree to indemnify, defend, and hold Black Dawg Bark harmless against any claims by persons or entities other than myself related to my dog’s participation in our Services. By enrolling my dog(s) in the Services, I warrant and represent that I am the legal owner or caretaker of my dog and assume all risks, dangers, and responsibility for injuries to my dog. I understand and agree that I am solely responsible for any harm to my dog(s) while my dog(s) is utilizing the Services. I understand and agree that I am solely responsible for any harm or damage caused by my dog(s) while utilizing the Services. I agree to notify Black Dawg Bark of any and all alleged problems with the Black Dawg Bark within twenty-four (24) hours of my dog(s)’s use of the Services.

I understand that by enrolling my dog(s) in the Services, I have read, understand, and acknowledge this Service Contract.

DAYCARE/BOARDING REQUIREMENTS

I confirm that my dog(s)

• is up to date with all vaccines.

• is in good health and free of fleas, ticks, and parasites.

• has received a recent fecal test in order to attend.

• is fit to participate in our outdoor activities such as running.

ACCEPTANCE AND ACKNOWLEDGMENT OF OFF LEASH AND CAGE FREE PLAY ACTIVITIES' PARTICIPATION RISK

I fully understand that:

(a) There are potential activities related to symptoms or injuries such as bites, scratches, diarrhea, vomiting, Leg injuries, paw allergies, or any other symptoms even though your dog(s) are carefully supervised at all times during the activities.

(b) There are inherent and potential risks involved with interactions between humans and dogs, as well as between dogs and other dogs, which may result in property damage or bodily injury, including permanent disability, sickness, or death to human or dog.

(c) There may be other risks not known to the owner or staff nor readily foreseeable at this time (Collectively “Risks”). While Black Dawg Bark will take all reasonable steps to ensure that any risks are limited, I fully accept and assume all responsibility and liability for all risks, including, without limitation, all losses, costs, and damages incurred as a result of me or my dog(s)’s participation in Black Dawg Bark indoor and outdoor play activities.

VETERINARIAN LIABILITY AND CARE

If your dog(s) requires urgent medical attention, Black Dawg Bark will first contact you by mobile number in order to make the necessary arrangements.

If you cannot be reached and medical attention is required urgently, you hereby authorize Black Dawg Bark to obtain medical treatment for your dog(s), if, in its sole discretion it appears that he/she is ill, injured, or exhibits any other behavior that would reasonably suggest that your dog may need medical attention.

I AGREE THAT I AM FULLY RESPONSIBLE FOR THE COST OF ANY SUCH MEDICAL TREATMENT, PROVIDED TO MY DOG.

TRAINING TECHNIQUES

We offer adult dog and puppy training with a range of techniques to which the individual is suited.

AGGRESSIVE DOGS

If my dog(s) show any signs of aggression to other dogs or humans, I hereby authorize Black Dawg Bark, its employees, and/or representatives to use any of their training gear such as muzzle, or leash, or methods such as separation or isolation, etc for safety purposes.

ZOOM

Our online training sessions are conducted online through video calls using Zoom. However, in case of any issues with Zoom, we have alternative video call software like WhatsApp, FaceTime, and Facebook video readily available. If you are not familiar with video calls, please inform us in advance, and we will try our best to assist you in setting up the video call. However, we cannot guarantee that we will be able to do so.

REFUND

We offer no refunds on any packages if you have a change of plans or need to cancel.

The purchaser must inform Black Dawg Bark in writing and will be subject to the following terms and conditions:

a. The purchaser has 7 days from purchasing the training course to notify Black Dawg Bark that they wish to cancel the course. A full refund will be given less an administration fee of 20% of the full course fee.

b. If the course has been started within 7 days of purchasing the course, the sessions taken will be deducted from the refund, less an administration fee of 20% of the course fee.

c. No refund will be given if the course has been completed within 7 days.

d. If notice is given later than 7 days of the date of purchase, or the purchaser changes their mind partway through the course and no longer wishes to complete the sessions, no refund will be given. The only exemption will be upon rehoming or death of the dog. You will be required to give evidence.

e. If you need to change the date of an individual session, you must provide a minimum of 24 hours' notice. Failure to do so will result in charges for the canceled session.

TERMINATION

Black Dawg Bark has the authority to terminate the contract immediately if they believe continuing with the contract poses a significant danger to the dog, other animals, the owner, or other individuals involved.

WALKS

All dogs will be exercised on a lead during training walks unless a prior agreement has been reached with Black Dawg Bark and the owner.

The trainer will apply personal judgment and cut short a walk, if necessary, because of extreme weather conditions, including, but not limited to, excessive heat, torrential rain, tornadoes, thunderstorms, and snow/ice. The decision to do so lies with the judgment of the walker, for the safety of themselves, members of the public, other animals, and the recipient. In such circumstances, the decision to refund that session (complete or partial) is at the discretion of Black Dawg Bark.

Although we cannot fully guarantee a 100% success rate with our training methods, however, we have a high success rate with previous clients who follow and practice our methods in the long term.

We provide dog training services during our sessions, however, proofed results in all environments are never instant and take commitment from the client to work with their dog in the long term.

SAFETY

All dogs known to bite other dogs or cause injury are advised to wear a muzzle; we take no responsibility for dogs who are not muzzled or kept under control, during our session or when working outside of our session.

Dogs must always be kept under control if we enter your premises. In most cases, we will meet the owner outside first without their dog during coach sessions. Failure to do so and any injury caused by your dog being out of control will be your full responsibility.

STOOGE DOG

In some cases, we use stooge dogs to aid training. During coaching walks, you will be responsible for keeping your dog a sufficient and safe distance from the stooge dog and, if asked, will need your dog to wear a muzzle during these sessions.

SOCIAL MEDIA APPROVAL

I am happy for Black Dawg Bark to share success stories about my dog via social media and share photos.

TESTIMONIAL

I am happy to write a testimonial if requested.

CHECK-IN

I agree to report/check in regularly about my dog’s progress through either WhatsApp, e-mail, text, or Instagram, by sharing on our Facebook page, Facebook group page, or responding to any communication from Black Dawg Bark. Continual failure to do so can result in the termination of your support.

PRICES

Prices are subject to increase; you will be given prior notification if price changes will take place.

PHOTOS AND VIDEOS

I allow Black Dawg Bark owner, and employees, to use my dog’s name, images, and video taken while at Daycare in any form, format, for use, at any time, in any media, marketing, advertising, illustration, and trade or promotion materials. I agree that this provision shall be bound to me and all my successors, heirs, legal representatives, and assignees.

I HAVE READ THIS AGREEMENT AND UNDERSTAND THAT IT IS AN AGREEMENT TO INDEMNIFY BLACK DAWG BARK AND THE OTHER RELEASED PARTIES AND IT IS A WAIVER AND RELEASE OF LIABILITY AND A PROMISE NOT TO SUE OR MAKE A CLAIM. I AM AWARE THAT THIS AGREEMENT IS A CONTRACT BETWEEN BLACK DAWG BARK AND ME, AND THAT BY ENROLLING MY DOG(S) IN THE SERVICES, I HAVE ACKNOWLEDGED THIS SERVICE CONTRACT.
